Are you or your relative overpaying nursing home fees
Many people who are paying for the cost of healthcare either for themselves or an ailing relative might, in fact, be eligible for a refund from The Primary Care Trust. A landmark court case has resulted in the NHS reimbursing nursing care costs. Could you have paid for services that should been fully funded?
Continuing healthcare is where the NHS is responsible for (and fully funds) the care of very ill patients, often elderly, in nursing homes. It can also apply to a person who is in hospital long term or needs nursing care at home. Primary Care Trusts cover all parts of England and receive their budgets directly from the Department of Health enabling the Trusts to control local healthcare. In this case the patient and her daughter had been making payments that should have been picked up by the NHS.
The High Court approved a settlement of a claim against Plymouth Primary Care Trust for nursing care (continuing health care) brought by Hugh James Solicitors on behalf of a client, Mrs Atkinson. The Primary Care Trust agreed to pay back the sum of £43,602.99 to Mrs Atkinson and to pay for her future nursing care costs. In addition the Trust agreed to pay back the third party contributions paid by her daughter, Mrs Badcock, who had been making the payments towards her mother's nursing care since January 2004.
Hugh James is currently acting on behalf of 400 clients to reclaim money that has been paid for long term care fees.
