Why Make a Will?
We all need to make Wills to be certain that the people we want to benefit actually do so. Do not to leave such things to chance.

If you die without leaving a valid Will you are said to have died Intestate. If you have made a Will and this has not been completed correctly it will have no effect on your death and the Intestacy rules will apply. This will be the same as if you had not left a Will.
The problem with intestacy is that it is difficult to undo if there are disagreements in the family. It can also be very difficult, time consuming and as a result expensive, to trace all the heirs, or the persons entitled to share an estate.
There are special rules that apply when you divorce. The law is quite clear that the divorced partner is regarded as having died at the date of the divorce i.e. before you, and thus will not share in the distribution of your estate, unless your Will shows a contrary intention.
The rule does not apply when you are separated and there is in this circumstance a greater need to remake your Will. Also remember that when you marry or remarry your existing Will is revoked unless it was made in contemplation of that marriage.
Partners are not really recognised in English Law although the position is slowly changing. At the moment the popular concept of a common law wife or husband does not exist. There is some protection under recent legislation so that a partner who has lived with the deceased for at least two years can make a claim for proper provision, but it is still a long and potentially expensive process.
It would be better for both parties to complete comprehensive Wills to remove misunderstanding and with it, the resultant anguish and possible hardship for the survivor.
